As a Nurse Practitioner performing C&P exams, you may wonder β or even be asked β whether a Veteran is allowed to record their exam. Itβs becoming more common, especially as Veterans want to track their care or protect their rights.
βοΈ State Laws Matter
Whether a Veteran can legally record a C&P exam depends on state law, specifically the stateβs consent rules for recording conversations:
- π£οΈ One-Party Consent States: Only one person involved in the conversation (like the Veteran) needs to consent. Recording without your permission may still be legal in these states.
- π₯ Two-Party (All-Party) Consent States: Everyone involved must give permission to be recorded. In these states, a Veteran recording without your knowledge could be breaking the law.
ποΈ What About VA & Contractor Policy?
Even if state law allows it, VA facilities or contracting companies (QTC, VES, LHI, etc.) may have their own policies prohibiting recordings of C&P exams. Some may require written approval or deny the request altogether.
